International Cardholder Surcharging – ATMIA has also been instrumental in passing legislation authorizing surcharging on international cardholders in the following 21 states:

Alabama
; Arkansas; California; Colorado; Florida (Effective July 1, 2008!); Georgia: Hawaii (March 31,2008); Idaho; Louisiana; Maine; Minnesota; Mississippi; Montana; Nevada; New York; Tennessee; Texas; Utah; Washington; Wisconsin (Effective  April 1,2008);Wyoming

NYC Intro 80-A - The NYC Council Committee on Consumer Affairs will be holding a hearing on Intro 80-A, A Local Law to amend the administrative code of the city of New York in relation to registering private ATM machines, on Monday June 23 at 1pm at 250 Broadway, 14th Floor, NY, NY 10007.

·         Mike Keller (Cardtronics) will testify on recent technical upgrades to ATM, i.e. 3DES and EPP; placement of their ATMs in stores (i.e. where they can be observed); that ATMs are not the source of identity theft; and impact of other NY county ATM laws on the deployment of ATMS. 
·         Richard Stern (TRM/Access To Money) will speak to the distribution of ATMs in the city; merchant ownership; and the fact that our non-bank ATMS serve as the ‘bank’ for many New Yorkers—pointing out how banks have recently increased their fees to non-bank cardholders.


New York A.B. 3288/S.B. 3864 –Bills requiring operators of private automated teller machines to register their machines with the Superintendent of Banks while requiring a fee for the registration of such machines. 
·    ATMIA provided a Memo in Opposition 
·    The bill is now dead for the session due to our hard work
Wyoming Surcharge Cap - The current legislation allows for up to a $2.00 surcharge, but places the final decision in the hands of the banking commissioner who is evidently responsible for a $1.50 cap.
 
·         ATMIA provided a letter of support to the State of Wyoming, Department of Audit amending the Wyoming Statute 12-1-502(f) to increase the Surcharge Cap to $2.00USD.
 
US Industry Defense Fund - The US Industry Defense Fund is used by ATMIA’s Government Relations Committee to cover the costs of our legislative efforts. The fund is properly registered and audited as part of the ATM Industry Association’s annual audit and is managed in a transparent way by the GRC, reporting to the Executive board of ATMIA. All contributors and sponsors of this fund will have the option of being part of the voting process within the GRC for approving disbursements from the fund.
In the past year, we have seen shrinking margins on the ATM revenue stream as a result of various external factors. We need your help now more than ever to continue efforts and affect positive change. Donations to the US Defense fund will help in our cooperative efforts with various government bodies and industry associations. 
Please, make your donations to the US Industry Defense Fund attention Sharon Lane, Director of Member and Financial Services, ATM Industry Association, P.O. Box 88433, Sioux Falls, SD 57109-8433. The recommended minimum donation for small companies is $250 and for large organizations it is $1,000. For additional information on the disbursement of funds please review the attached document.
