All ATM Deployers with Business in Virginia – Oppose Virginia HB 1519

On February 8th, the State of Virginia introduced HB 1519to amend and reenact §§ 59.1-199 and 59.1-200 of the Code of Virginia, relating to the Virginia Consumer Protection Act; fees for electronic fund transfers; prohibited.”  The language of this bill is very innocuous, and you need to read the references to CFPB code in order to find the connection to ATMs. 

The relevant section of the bill itself is pasted in below:

§ 59.1-200. Prohibited practices.

  1. The following fraudulent acts or practices committed by a supplier in connection with a consumer transaction are hereby declared unlawful:

79. Charging any transaction or processing fee or similar surcharge for the use of an electronic fund transfer, as that term is defined in 12 C.F.R. § 1005.3, for payment for the purchase of a good or service.

All ATMIA members with business operations in Virginia are encouraged to contact their state representatives and oppose this bill. More information will be forthcoming. Stateside will be adding this measure to our alerts list.
