This measure establishes that a state agency or political subdivision may not restrict the use or sale of a motor vehicle based on the energy source used by the motor vehicle. CALIFORNIA
The Senate Appropriations Committee will hold a hearing on May 6 regarding the following:
- SB 942: This measure establishes the California AI Transparency Act which requires a covered provider to create an AI detection tool by which a person can query the covered provider as to the extent to which text, image, video, audio, or multimedia content was created, in whole or in part, by a generative AI system provided by the covered provider that meets certain criteria, including that the AI detection tool is publicly accessible and available via a uniform resource locator (URL) on the covered provider’s internet website and through its mobile application, as applicable.

- SB 983: This measure would require the commission to form the Alternative Fuels Infrastructure Taskforce to conduct a study on retail gasoline fueling stations and alternative fuels infrastructure, as provided. This measure would require the task force, on or before January 1, 2027, to submit to the Legislature a report on the study with recommendations.

- SB 1047: This measure establishes the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act to authorize a developer of a covered model to determine whether a covered model qualifies for a limited duty exemption before initiating training of that covered model.

- SB 1053: This measure requires a reusable grocery bag sold by a store to a customer at the point of sale to meet different requirements, including that it be made from woven textile or washable textile and it complies with Section 260.12 of Part 260 of Title 16 of the Code of Federal Regulations related to recycling claims if the reusable grocery bag producer claims that the reusable grocery bag is recyclable.

The Berkeley City Council will meet on May 7 to consider an ordinance incorporating updates to California’s Building Standards Code while preserving certain more stringent local amendments the city has previously adopted. Proposed actions include retaining previously adopted local amendments to the 2022 California Plumbing Code to require the installation of motion-activated gas shut-off valves in new construction and alterations or additions to existing buildings containing fuel gas piping and adopting modified amendments to the 2022 California Green Buildings Standards Code (CALGreen) to retain Berkeley’s more stringent electric vehicle charging requirements in all building types. The ordinance will also introduce new amendments to the 2022 California Green Buildings Standards Code (CALGreen) to require Zero NOX Buildings for newly constructed buildings.

The Assembly Appropriations Committee will hold a hearing on May 8 regarding the following:
- AB 2029: This measure requires the State Energy Resources Conservation and Development Commission, beginning January 1, 2025, to biennially conduct an assessment, in consultation with applicable state and federal agencies, of the abidance of electric vehicle charging stations with accessibility requirements and related guidance from relevant state and federal agencies.

- AB 2453: This measure prohibits, until January 1, 2028, requiring electric vehicle supply equipment (EVSE) to be retested or placed in service by a service agent or sealer if the EVSE has previously been placed in service by a service agent or sealer before the EVSE is used after receiving routine repairs.

- AB 2602: This measure provides that a provision in an agreement between an individual and any other person for the performance of personal or professional services is unenforceable only as it relates to a new performance, on or after January 1, 2025, by a digital replica of the individual if the provision meets specified conditions relating to the use of a digital replica of the voice or likeness of an individual in place of the work of the individual.

- AB 2655: This measure establishes the Defending Democracy from Deepfake Deception Act of 2024 to prevent the online dissemination of manipulated media and disinformation meant to deceive voters and prevent them from voting. The measure requires a large online platform to block the posting or sending of materially deceptive and digitally modified or created content related to elections, during specified periods before and after an election. A large online platform must label certain additional content inauthentic, fake, or false during specified periods before and after an election.

- AB 2930: This measure requires a health facility, clinic, physician’s office, or office of a group practice that uses generative artificial intelligence to generate written or verbal patient communications to ensure that those communications include both (1) a disclaimer that indicates to the patient that communication was generated by generative artificial intelligence, as specified and (2) clear instructions permitting a patient to communicate with a human health care provider.

ILLINOIS
The Senate Judiciary Committee will hold a hearing on May 7 regarding HB 4762. This measure establishes that an agreement and or contract between individuals for the rendering of personal or professional services can be deemed unenforceable as a matter against the public good if all of the following conditions exist:
- the provision allows for the creation and use of a digital replica of the individual's voice or likeness in place of work the individual would otherwise have performed in person;
- the provision does not clearly define and detail all of the proposed uses of the digital replica or the generative artificial intelligence system; and
- the individual was not represented by legal counsel or by a labor union acting in a specified capacity.

NEW HAMPSHIRE
The House Commerce and Consumer Affairs Committee will hold a work session on May 7 regarding SB 557. This measure prohibits insurers and pharmacy benefit managers from discriminating against 340B entities and contracted pharmacies. It prohibits both network requirements and lower reimbursement rates for drugs dispensed to 340B covered entities.

The House Finance Committee will hold a work session on May 7 regarding SB 393. This measure appropriates $25,000,000 for the fiscal year ending June 30, 2025, to the Department of Environmental Services from a combination of federal funds, the drinking water and groundwater trust fund established, the PFAS remediation loan and grant fund, and local contributions to fund regional drinking water infrastructure as part of Phase 2 of the Southern New Hampshire Regional Water Project to increase water supply by over 2 million gallons per day to multiple towns impacted by per- and polyfluoroalkyl substance contamination and growing water demands.

NEW YORK

This measure requires the Department of Health (department) to establish drug-checking services programs to allow individuals to bring drugs or controlled substances and have them tested for contaminants, toxic substances, or hazardous compounds.

- SB 4447: This measure allows pharmacies to use automated dispensing devices to store, package, and dispense medications, including controlled substances.
- SB 5914: This measure allows a pharmacist to substitute an alternate epinephrine auto-injector containing the same active ingredients, dosage form, and strength as a brand name product regardless if the alternate epinephrine auto-injector is included in the latest list of interchangeable drug products.
OHIO
The House Criminal Justice Committee will hold a hearing on May 7 regarding HB 401. This measure provides that no person, without the consent of the depicted individual, to harass, extort, threaten, or cause physical, emotional, reputational, or economic harm to an individual falsely depicted, knowingly do any of the following:
- Create a deepfake with intent to distribute;
- Distribute a deepfake;
- Solicit the creation of a deepfake with the intent to distribute.
